Judge Warns Insanity Defense Not an Easy Out
Retired Massachusetts Superior Court Judge Jack Lu told Fox News Digital that even if Clancy is found not guilty by reason of insanity, she would likely spend years in a mental institution, with release decisions driven by prosecutors.
Clancy, 36, faces three counts of first‑degree murder for the January 2023 stranglings of her children Cora, Dawson and Callan, all under six, at the family’s Duxbury home.
He said a panel of mental‑health officials, largely aligned with prosecutors, would periodically review her commitment, making release difficult.
Legal Pathways and Jury Dynamics
Lu explained that a contested hearing before a judge could allow Clancy to win release if doctors do not certify she is no longer a danger, but such a route is rare.
The jury, composed of nine women and three men led by a female foreperson, has asked to be dismissed for the day and will reconvene Tuesday morning, still without a verdict.
Legal analysts note the case mirrors the 1954 tragedy of Maine mother Constance Fisher, who drowned three children, was committed to a mental hospital, later returned home, and was rearrested for additional killings.
Prosecutors have described the defense’s strategy as “tone deaf,” “uncaring,” and “snarky,” according to defense attorney Kevin Reddington.
