A Chinese national living in Andover, MA, was arrested today for submitting a fraudulent voter registration and ballot in the 2024 presidential election while impersonating another Chinese national.
Defendant and Allegations
Yupeng Sun, 33, faces one count of fraudulent voter registration and one count of fraudulent voting.
Court filings show that on Oct. 10, 2024, Sun filed an online voter registration on the Secretary of the Commonwealth’s website, pretending to be a lawful permanent resident.
On Oct. 31, 2024, he submitted an early voting ballot at Malden City Hall under the same false identity, the 2024 U.S. presidential election.
Immigration Fraud
Sun also filed two fraudulent immigration forms on behalf of the victim and his wife, prompting the confiscation of their Green Cards and initiating removal proceedings.
He later submitted anonymous tips to Homeland Security Investigations and USCIS, claiming the victim “illegally voted” despite being a non‑citizen permanent resident.
Legal Consequences
The charges each carry up to five years in prison, three years of supervised release and a $250,000 fine, with deportation imposed after any sentence.
Sun is scheduled for an initial appearance in federal court in Boston at 2:00 p.m. today.
Investigation and Prosecution
U.S. Attorney Leah Foley and Acting Special Agent in Charge Jeff Grimming of Homeland Security Investigations announced the case, with assistance from the Lexington and Andover police departments.
Assistant U.S. Attorney James J. Nagelberg of the Major Crimes Unit is prosecuting.
The charging documents allege Sun’s actions; he remains presumed innocent until proven guilty beyond a reasonable doubt.
