Education Department blows up Obama-era rules that used race data to police school discipline, declaring the policy “weaponized” and unconstitutional. The move follows the Justice Department’s December decision to scrap disparate‑impact liability under Title VI.
Policy Shift
Disparate‑impact theory holds that a neutral rule can be discriminatory if it disproportionately harms one group, even without intent. It argues that neutral policies can still produce unequal outcomes.
The department said the Obama administration “weaponized” the theory to force schools to consider race in disciplinary decisions, citing OCR findings that race‑neutral policies were deemed violations when minority students were disciplined more often.
Such ideology demands equal outcomes across demographics, meaning students of certain races may avoid discipline even when they break rules. It also pressures schools to treat all groups the same regardless of actual behavior.
The agency links the deregulation to President Trump’s April 2025 executive order restoring meritocracy, calling disparate‑impact liability a “killer of merit.” It says the policy violates equal treatment under law.
Assistant Secretary for Civil Rights Kimberly Richey said the changes empower schools to maintain safe classrooms without fearing federal weaponization of antidiscrimination laws, and ensure Title VI is enforced as Congress intended.
Previously, schools tracked disciplinary data by race; a dataset showing higher discipline rates for minorities triggered federal civil‑rights threats, prompting schools to manipulate records, ignore infractions for minorities, or over‑penalize white students.
